Terms & Conditions

Please read the following terms and conditions carefully before using our services.

Agreement to these terms

These Terms and Conditions ("Terms") are a legal agreement between you and Mohamad El Naboulsi, the owner and operator of Cotenos ("Cotenos", "we", "us" or "our"), based in Tripoli, Lebanon. They govern your use of the Cotenos mobile app, the Cotenos website (cotenos.org) and the Cotenos business dashboard (together, the "Services").

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

What Cotenos does

Cotenos is a platform that helps players discover sports venues and coaches, check availability and request bookings, and helps venue owners, managers and coaches manage their venues, schedules and bookings. You can look at venues and coaches in the app without an account. You need an account to book.

Venues and coaches are independent businesses. They set their own prices, availability and rules, and they are solely responsible for their facilities, services, staff and safety. Cotenos is not a party to the arrangement between you and a venue or coach, and does not operate venues or provide coaching.

Eligibility and your account

  • You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the permission and supervision of a parent or legal guardian, who accepts these Terms on your behalf.
  • You must give accurate information and keep it up to date.
  • You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at info@cotenos.com if you think someone has used your account without permission.
  • Accounts are personal. Do not share your account or create an account for someone else without their permission.
  • You must confirm your email address before you can make a booking.
  • Venue owner accounts are set up by Cotenos, after a partner application. A venue owner can invite an existing account to manage a venue; the invitation is accepted from a link sent by email. Coach accounts are subject to our review, and we may approve, decline or suspend a coach profile.

Bookings

  • A booking made through the Services is a request for a time slot at a venue, and optionally with a coach. A booking is confirmed only when the venue (and the coach, where applicable) confirms it in the Services. Venues and coaches may accept or decline requests. A request that the venue has not confirmed by the start of the time slot expires. When a booking includes a coach, the coach has 24 hours to answer after the venue confirms, and the request expires if the coach does not answer.
  • To keep bookings fair, you can have up to 5 open booking requests at a time, and you can book up to 30 days ahead.
  • Prices are set by the venue or coach and are shown in US dollars unless stated otherwise.
  • You can cancel a booking in the app while it is pending or confirmed. Venues and coaches may have their own cancellation, lateness and no-show policies, which apply to your booking.
  • A venue can also record a booking for a customer who calls or walks in.
  • If a venue is closed or removed from Cotenos, its upcoming bookings are cancelled and the players and coaches concerned are notified.
  • Please arrive on time and follow the venue's rules and safety instructions. Repeated no-shows or misuse of bookings may lead to restrictions on your account.

Payments

Cotenos does not process payments for bookings. You pay the venue, and the coach where applicable, directly under their own payment terms (for example, at the venue). Questions about prices, charges, refunds or receipts should be directed to the venue or coach.

Subscription plans for venue owners, and their prices, are shown on our website. Fees, payment and renewal are agreed between the owner and Cotenos. Some features of the business dashboard depend on the owner's plan.

Coaches

If you offer coaching through the Services, you confirm that the information in your profile, including your experience and qualifications, is accurate; that you hold any licenses, certifications and insurance required for your services; and that you are responsible for the sessions you provide. You are an independent provider, not an employee or agent of Cotenos.

Venue owners and managers

If you list or manage a venue, you are responsible for:

  • keeping your listings accurate, including photos, prices, opening hours and availability;
  • honoring confirmed bookings;
  • complying with all laws that apply to your business, including licensing, health and safety, and consumer protection; and
  • using customers' personal information that you receive through the Services only to manage their bookings, and protecting it in line with applicable data protection laws.

Venue owners are responsible for the actions of the managers they add.

Reviews and other content

  • You may post reviews, ratings, photos and other content ("Your Content"). You keep ownership of Your Content, but you give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce and adapt it (for example, resize a photo) for the purpose of operating and promoting the Services.
  • Reviews must be honest and based on your genuine experience. You can review a venue or a coach only after a booking you made there was played. You have one review for each venue or coach, and you can edit it.
  • We have zero tolerance for objectionable content and abusive users. You must not post content that is unlawful, false or misleading, defamatory, harassing, threatening, hateful or discriminatory, sexually explicit, violent, or that infringes anyone's rights or privacy, and you must not post spam.
  • We may remove any content, and suspend or terminate any account, that violates these Terms. A review removed by our team cannot be posted again.
  • To report a review, or to block a user so that you no longer see their reviews, use the menu on the review itself in the app. You can also write to us with "Report a problem" in the app's Settings, or at info@cotenos.com. We aim to review reports within 24 hours.
  • Use "Report a problem" for genuine problems only. Do not send false, abusive or repeated reports.

AI features

Text generated by AI features, such as AI-written venue descriptions and business insights in the business dashboard, may be inaccurate, incomplete or out of date. They are provided for general information only and are not professional advice, including medical, fitness or nutrition advice. Talk to a qualified professional before starting a new exercise or nutrition program, and always check booking details in the app.

Acceptable use

You agree not to:

  • use the Services for anything unlawful, fraudulent or harmful;
  • make fake bookings, or create accounts using false information;
  • collect or misuse other users' personal information;
  • access the Services by automated means such as bots or scrapers, or interfere with, disrupt or overload them;
  • try to get around security measures, or access accounts or data that are not yours;
  • copy, modify, reverse engineer or resell any part of the Services, except as permitted by law;
  • upload viruses or other malicious code; or
  • impersonate anyone or misrepresent your connection to anyone.

Intellectual property

The Services, including the software, design, logos and the Cotenos name, belong to Mohamad El Naboulsi (Cotenos) or our licensors and are protected by law. Content provided by venues, coaches and users belongs to them.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the app and the Services for their intended purpose.

Apple App Store

If you downloaded the app from the Apple App Store, the following also applies:

  • These Terms are between you and Mohamad El Naboulsi (Cotenos) only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
  • Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • We, not Apple, are solely responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.

Apple App Store: warranty and claims

  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses caused by any failure to conform to a warranty are our responsibility, to the extent they are not disclaimed under these Terms.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.

Apple App Store: other terms

  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms (such as your mobile carrier's terms) when using the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Questions, complaints or claims about the app should be sent to us using the contact details at the end of these Terms.

Third-party services

The Services may include sign-in through Apple or Google, links to third-party websites, and other third-party services. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

Disclaimers

The Services are provided "as is" and "as available". To the extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, secure or error-free, or that listings, prices, availability or other information provided by venues, coaches or users are accurate.

Sports and physical activity involve a risk of injury. You take part in any activity, at any venue or with any coach, at your own risk. We are not responsible for the condition or safety of venues, or for the conduct of venues, coaches or other users.

Limitation of liability

To the maximum extent permitted by law, Mohamad El Naboulsi (Cotenos) will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Services. We are also not liable for injuries, losses or disputes arising from venues, coaches, bookings or other users.

To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to one hundred US dollars (USD 100).

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or gross negligence.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Mohamad El Naboulsi (Cotenos) from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your breach of these Terms, Your Content, or your use of venues or coaching services booked through Cotenos.

Suspension and termination

You can stop using the Services at any time, and you can delete your account in the app from your profile settings. If you own venues, deleting your account closes them and cancels their upcoming bookings; the app asks you to confirm first.

We may suspend or terminate your access to the Services if you breach these Terms, if we are required to by law, or if needed to protect our users or the Services. Sections of these Terms that by their nature should continue after termination (such as Intellectual property, Disclaimers, Limitation of liability, Indemnity and Governing law) will continue to apply.

Changes to the Services and these Terms

We may change, suspend or discontinue any part of the Services at any time. We may also update these Terms from time to time. We will post the updated Terms in the app and on our website and change the "Last updated" date above. If the changes are significant, we will also let you know in the app or by email. If you keep using the Services after the changes take effect, you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of Lebanon. If you have a dispute with us, please contact us first so we can try to resolve it informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts of Tripoli, Lebanon. This does not take away any mandatory consumer protections you have under the laws of the country where you live.

General

  • These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Services.
  • If any part of these Terms is found to be unenforceable, the rest remains in effect.
  • If we do not enforce a right, that does not mean we waive it.
  • We may transfer our rights and obligations under these Terms in connection with a sale, merger or transfer of Cotenos. You may not transfer your rights or obligations without our written consent.
  • If these Terms are translated and there is any conflict between versions, the English version prevails.
